Ma Eun-hyuk, a candidate for the Constitutional Court justice, expressed his view that martial law decree No. 1, which prohibits the activities of the National Assembly and political parties, is a key issue in the Yoon Suk Yeol's constitutional trial.
During a confirmation hearing on the 23rd, candidate Ma, who is recommended by the Democratic Party of Korea, said, "I think the core of the impeachment judgment is the decree No. 1," adding, "What do you think about the fact that this clause will be the most important reason for judgment in neutralizing the constitutional institution?"
When Rep. Kim Jong-min asked, "Is it the criterion for determining whether or not the constitutional institution has been neutralized?" candidate Ma replied, "I understand that."
When Kim Han-kyu, a member of the Democratic Party of Korea, asked, "Isn't it possible to limit the authority of the National Assembly by emergency martial law?" candidate Ma replied, "That's how I understand it." When Rep. Kim Han-kyu asked, "Does the phrase of decree No. 1 mean limiting the authority of the National Assembly?" he said, "The sentence itself is understood in that sense."
The six-item decree No. 1, declared by the martial law command on the 3rd, is controversial for banning the activities of the National Assembly and political parties, which is interpreted as a statement that the judgment of unconstitutionality could determine the outcome of the impeachment trial.
While President Yoon argued that the president's high-level political governance is not subject to judicial judgment, candidate Ma said, "It is a constitutional practice that even if it is an act with a high political character of the president, acts closely related to the basic rights of the people are subject to judicial events."
Regarding the appointment of an acting president as a candidate for constitutional judge, candidate Ma said, "I think it is appropriate for the president or acting president to appoint an elected person as a constitutional judge if the National Assembly elects him through due process."
The hearing was held with only opposition lawmakers in attendance, with lawmakers from the ruling People's Power not attending.
On the 23rd, the Democratic Party of Korea will hold a confirmation hearing for candidate Ma and political candidates, and on the 24th, it will hold a confirmation hearing for lawyer Cho Han-chang recommended by the People's Power. The Democratic Party plans to vote on the appointment motion at the plenary session of the National Assembly as early as the 26th.
