Man wanted for rape in Oregon back in custody after his release from Martin County Jail

An undocumented man from Guatemala who is wanted for rape charges in the state of Oregon is back in custody, the Martin County Sheriff's Office (MCSO) says.

At the request of U.S. Immigration and Customs Enforcement (ICE) Martin County Sheriff deputies relocated Juan Jose-Sebastian, 26, on Saturday morning and is now in the custody of immigration officials.

According to MCSO Jose-Sebastian has been wanted in Washington County, Oregon since 2017 for rape and sexual abuse. He was originally booked into the Martin County Jail for driving without a license, but his sentence for that crime was served.

Pending his release jail officials learned that Jose-Sebastian was wanted in Oregon for rape. MCSO says they notified ICE, but federal authorities declined to hold him and Oregon officials declined to extradite him.

MCSO says it had no authority to keep him in custody, so he was released from jail with a notice to the public.

His release prompted action from Congressman Brian Mast, Florida Gov. Ron DeSantis and ICE officials out of Washington D.C.

Due to their action, Jose-Sebastian is now back in custody, MCSO says.
