A BILL
To impose sanctions on foreign persons failing to cooperate
with the United States.

1 Be it enacted by the Senate and House of Representa-


2 tives of the United States of America in Congress assembled,
3 SECTION 1. SHORT TITLE AND PURPOSE.

4 (a) SHORT TITLE.—This Act may be cited as the


5 ‘‘Make Gaza Great Again Act’’.
6 (b) PURPOSE.—The purpose of this Act is to specifi-
7 cally ensure the cooperation of Middle Eastern states, ex-
8 cluding the State of Israel, in offering humanitarian entry
9 to Palestinians from Gaza.

1 SEC. 2. IMPOSITION OF SANCTIONS ON FOREIGN PERSONS

2 FAILING TO COOPERATE WITH THE UNITED

3 STATES.

4 (a) IMPOSITION OF SANCTIONS.—Notwithstanding


5 any other provision of law, the President may impose the
6 sanctions described in subsection (c) with respect to each
7 foreign person included in the most recent list submitted
8 pursuant to subsection (b).
9 (b) LIST OF PERSONS.—
10 (1) IN GENERAL.—Not later than 60 days after
11 the date of enactment of this Act, the President
12 shall submit to the appropriate congressional com-
13 mittees a list of foreign persons charged with rep-
14 resentation of a foreign government who have re-
15 jected a request from the President to grant human-
16 itarian entry to Palestinians from Gaza.
17 (2) UPDATES OF LISTS.—The President shall
18 submit to the appropriate congressional committees
19 an updated list under paragraph (1)—
20 (A) not later than 180 days after the date
21 of enactment of this Act and annually there-
22 after for 5 years; or
23 (B) as new information becomes available.
24 (3) FORM.—The list required by paragraph (1)
25 shall be submitted in unclassified form, but may in-
26 clude a classified annex.

1 (c) SANCTIONS DESCRIBED.—The sanctions de-
2 scribed in this subsection are the following:
3 (1) BLOCKING OF PROPERTY.—The President
4 shall exercise all of the powers granted to the Presi-
5 dent by the International Emergency Economic
6 Powers Act (50 U.S.C. 1701 et seq.) (except that
7 the requirements of section 202 of such Act shall
8 not apply) to the extent necessary to block and pro-
9 hibit all transactions in property and interests in
10 property of the person if such property and interests
11 in property are in the United States, come within
12 the United States, or are or come within the posses-
13 sion or control of a United States person.
14 (2) INADMISSIBILITY OF CERTAIN INDIVID-

15 UALS.—

16 (A) INELIGIBILITY FOR VISAS, ADMISSION,

17 OR PAROLE.—A foreign person included in the


18 most recent list submitted pursuant to sub-
19 section (b) is—
20 (i) inadmissible to the United States;
21 (ii) ineligible to receive a visa or other
22 documentation to enter the United States;
23 and
24 (iii) otherwise ineligible to be admitted
25 or paroled into the United States or to re-

1 ceive any other benefit under the Immigra-
2 tion and Nationality Act (8 U.S.C. 1101 et
3 seq.).
4 (B) CURRENT VISAS REVOKED.—A foreign
5 person described in subparagraph (A) is also
6 subject to the following:
7 (i) Revocation of any visa or other
8 entry documentation regardless of when
9 the visa or other entry documentation is or
10 was issued.
11 (ii) A revocation under clause (i) shall
12 take effect immediately and automatically
13 cancel any other valid visa or entry docu-
14 mentation that is in the foreign person’s
15 possession.
16 (d) PENALTIES.—The penalties provided for in sub-
17 sections (b) and (c) of section 206 of the International
18 Emergency Economic Powers Act (50 U.S.C. 1705) shall
19 apply to a person who violates, attempts to violate, con-
20 spires to violate, or causes a violation of regulations pro-
21 mulgated to carry out subsection (a) to the same extent
22 that such penalties apply to a person who commits an un-
23 lawful act described in section 206(a) of that Act.

1 (e) EXCEPTION TO COMPLY WITH NATIONAL SECU-
2 RITY.—The following activities shall be exempt from sanc-
3 tions under this section:
4 (1) Activities subject to the reporting require-
5 ments under title V of the National Security Act of
6 1947 (50 U.S.C. 3091 et seq.).
7 (2) Any authorized intelligence or law enforce-
8 ment activities of the United States.
9 (f) WAIVER.—The President may, on a case-by-case
10 basis, waive the imposition of any sanction or any require-
11 ment under this section if the President—
12 (1) determines that such a waiver is in the na-
13 tional interest of the United States; and
14 (2) not later than 120 days after the date on
15 which the President imposes the sanctions described
16 in subsection (a), and every 120 days thereafter
17 until the date of termination under subsection (g),
18 the President shall submit to the appropriate con-
19 gressional committees a classified report on the ex-
20 tent to which the President has used the waiver au-
21 thority under paragraph (1) during the period cov-
22 ered by that report.
23 (g) SUNSET.—The authority to impose sanctions
24 under this section shall terminate on the date that is 5
25 years after the date of enactment of this Act.

1 (h) APPROPRIATE CONGRESSIONAL COMMITTEES
2 DEFINED.—In this Act, the term ‘‘appropriate congres-
3 sional committees’’ means—
4 (1) the Committee on Foreign Affairs of the
5 House of Representatives; and
6 (2) the Committee on Foreign Relations of the
7 Senate.
8 SEC. 3. SUSPENSION OF MAJOR NON-NATO ALLY DESIGNA-

9 TION AND FOREIGN ASSISTANCE.

10 (a) IN GENERAL.—The President may suspend a des-


11 ignation made pursuant to section 517(a)(1) of the For-
12 eign Assistance Act of 1961 (22 U.S.C. 2321k(a)(1)) and
13 suspend any and all forms of foreign assistance, to include
14 security assistance, for any country whose government has
15 declined a request by the President to offer humanitarian
16 entry to Palestinians from Gaza.
17 (b) TERMINATION.—The President may, concurrent
18 with written notice to the appropriate congressional com-
19 mittees, terminate any suspension made pursuant to sub-
20 section (a).
21 SEC. 4. RULE OF CONSTRUCTION.

22 Nothing in this Act may be construed to apply to


23 Israel or any national of the State of Israel.
