Justin Timberlake’s lawyer insists he was not intoxicated as DWI case goes before judge — with pop star nowhere to be seen

Justin Timberlake’s lawyer insisted the pop singer was not intoxicated when he blew through a stop sign and was arrested on a DWI charge in the Hamptons last month, as the case appeared before a judge Friday.

“Justin Timberlake was not intoxicated. And we’re very confident that that charge— that criminal charge will be dismissed,” the pop star’s lawyer, Edward Burke Jr., told reporters following a court appearance in the case Friday morning.

Timberlake, 43, did not appear in person at the proceedings, as he is scheduled to perform two concerts in Poland as part of his world tour on Friday.

During the appearance, Burke moved to dismiss the charges because the initial charging papers were only signed by the arresting officer and a part-time cop, instead of the superior officer.

The prosecutors, however, were prepared with new, signed paperwork on Friday – and Timberlake will now be arraigned a second time using the appropriate documents, Justice Carl Irace ruled.

“The verification has been fixed,” Assistant District Attorney Ashley Cangro said.

Timberlake was ordered to appear virtually for a rescheduled arraignment, which is set for 9:30 a.m. on Aug. 2.

“This arraignment is going to be just as real,” the judge insisted, noting that he will grant a notable exception by providing Timberlake with a virtual link for the proceeding.

“We don’t really give anyone but attorneys a remote video link,” he explained. 

After the proceedings, Timberlake’s lawyer bashed the prosecutors for the error in the charging papers.

“The police made a number of very significant errors in this case.,. And there are many others,” Burke said after the proceedings.

“The DA is trying to fix something here — you’re going to scratch your head and ask yourself why this wasn’t [resolved]  immediately? There’s not a spot of ink that has the sergeant’s signature.”

The “Sexy Back” crooner made headlines when he was arrested in Sag Harbor in the early hours of June 18 after he blew through a stop sign near the swanky American Hotel.

The NSYNC alum failed a field sobriety test and was arraigned on a single DWI count.

The incident sparked a slew of internet memes when news broke that cop who pulled Timberlake over did not recognize him.

When Timberlake protested that his arrest would “ruin the tour,” the confused officer needed him to explain further – forcing the chart topper to mumble about his ongoing “world tour.”

“Sometimes the police, just like every one of us, make mistakes. And that’s the case in this very incident,” Burke said of the snafu that required his client to be arraigned again.

“I will say that Justin respects law enforcement. I will say that he recognizes the very important job that they do. And he cooperated with the police officers from the second he was ordered out of his car to the second he was discharged on June the 18th from Judge Irace,” the attorney continued.

“He also respects the entire judicial system, the district attorney’s office and Judge Irace for obviously hearing the case today.

“But the facts remain. He was not intoxicated,” Burke insisted.

At his first post-arrest concert in Chicago, Timberlake thanked his fans for sticking by him.

“It’s been a tough week,” he admitted at the time. “I know sometimes I’m hard to love, but you keep on loving me and I love you right back.”
