Beta Technologies has raised $318 million in Series C equity capital. QIA led the raise and several of BETA’s largest investors, including Fidelity Management & Research Company and TPG Rise Climate increased their ownership in BETA. Longtime customer United Therapeutics has also joined this round as an investor. This analysis, at least anecdotally makes sense to me. In many situations, infringe and holdout is the least painful option for large infringers. The system enables it. - The plaintiff must allocate the time and $$ to assert, taking time and $$ away from selling and developing products. Even if they engage litigation financiers they are limiting their upside potential. - The infringer continues to infringe while employing stall tactics or simply relying on the painfully slow, overburdened legal system. - The cost benefit analysis for infringers - "infringe and pay lawyers" typically outweighs the cost of design around or license. - Enhanced damages and injunctions are rare. - Litigation insurance products reduce risk all around. "The Marcum report shows that there is indeed something wrong with the patent system in the United States but it’s not excessive litigation or patent trolls. The real problem is the inability of patent owners to enforce their rights against infringers. Given the difficulty of obtaining injunctive relief and the limited enhancement of damages, it is unsurprising that predatory infringement has become a standard business practice when, at worst, all an infringer can be expected to pay is a reasonable royalty and, at best, nothing at all."

AI and Med Tech in Focus   AI System Developed to Identify Pathology in Tissues Engineers at Washington State University have developed an AI tool that uses images of human and animal tissue to detect abnormalities faster and more accurately than people. The AI algorithm was trained using images from past studies that involved kidney, testes, ovarian, prostate, breast and lymph node abnormalities. The new model detected disease in minutes—current processes take humans several hours and require specialized teams to check each other’s work. It was also found to be more accurate, sometimes detecting instances that humans had missed. The engineers designed the system to handle the processing load of the high-resolution gigapixel images by breaking them down into smaller tiles but still retaining the overall context of the tissue sample—akin to the zoom feature on a microscope or phone camera. Aside from getting diagnostic results more accurately and quickly, the new system also shows promise in epigenetics (the study of molecular processes that change gene behavior without changing underlying DNA). Epigenetic researchers can perform analyses and get results that used to take a year or more in just a couple of weeks. The NTIA/Verisign Cooperative Agreement for .Com impacts the fundamental workings of the Internet infrastructure and US digital sovereignty. This article in Circle ID from last week sums up the problems of the Internet Plumbing Monopolies. Is Verisign a Monopoly? Does It Matter? https://lnkd.in/eQ2UrGu4 Here is my response to the article: Your arguments regarding the price of .com are logical; however, the issue of Verisign’s monopoly extends beyond just .com pricing. It also concerns the monopoly power that Verisign holds within the DNS ecosystem, a power given it through the NTIA Cooperative Agreement and Amendment 35 without any US public or Congressional input or oversight. This monopoly power has significant implications for undermining ICANN’s “multi-stakeholder” process. We have seen this in several instances, such as Verisign’s failure to implement a “Thick WHOIS,” despite being an agreed-upon consensus “multi-stakeholder” policy of ICANN back in 2016 (and now required as part of NIS2). Furthermore, Verisign has collaborated with other “contracted parties” to narrow the definition of DNS Abuse by excluding CSAM and IP violations even though the US and EU DNS Abuse definitions include both. Even more troubling is that Verisign has been colluding with ICANN to secure its policy objectives that are counter to the protection of US cybersecurity and consumer/child protection. This has occurred through bilateral contract negotiations - such as those involving .com price increases, DNS Abuse definition, and blocking efforts to ensure an open, accurate, and accessible WHOIS - and ICANN policies involving NIS2 and the US cybersecurity reporting law (CISA). #versign #icann #whois #darkwhois #internetplumbingmonopolies #nationalsecurity #cybersecurity
