Dear Commissioners,
I’m writing to request — no, to implore — that you deny parole for the above referenced inmate, who 20 years ago was sentenced to 350 years-to-life in prison for sexually molesting a 5-year-old girl. He was 49 years old at the time — old enough to be her grandfather, and certainly old enough to know exactly what he was doing.
The basic facts stated above are vile enough. But the details of the crime are worse.
Inmate Mix was not a stranger to the child, but a "friend" to both the child and her father. They lived together in the same home, where he took advantage of his proximity, family-like relationship, and a very young child's trust — heaping long-lasting emotional damage atop the physical.
Inmate Mix also took sexually explicit photographs of the girl and was ultimately convicted of kidnapping for the purpose of committing rape, burglary and lewd acts with force, violence or duress. Not only did he steal her innocence and the inviolability of her home (where all children should feel safe), but he actually tried to steal her away from her family! He professed his romantic "love" for her in myriad love letters and claimed that his feelings were reciprocated — BY A 5-YEAR-OLD.
According to Riverside County Superior Court Judge Christian F. Thierbach, who presided over the trial, "the human race has yet to create a punishment that adequately addresses what you [Mix] did to this little girl, and I suspect one reason for that is what you did to her is inhuman." I could not agree more.
The judge later went on to tell Inmate Mix that the only way he would be freed from prison was if he received a pardon, and continued by saying:
“I dare say if that happens, civilization as we know it will have ceased to exist.”
Little did Judge Thierbach know that the California Legislature would pass and implement their version of a "pardon lite" — the Elderly Parole Program, which has allowed Inmate Mix the opportunity to seek parole after serving just 6% of his sentence.
If this is allowed to happen, Thierbach's warning will certainly ring true, and civilization as we know it will cease to exist as our criminal justice system facilitates the release of violent child predators back into society.
In the interest of justice for that five-year-old girl who still suffers today – and every other child who is his potential prey – I strongly urge you to deny parole to Inmate Mix. All of society is better off if he serves out his remaining years behind bars. Thank you.
