The brother of the man alleged to have killed a nursing student on the campus of the University of Georgia last month was indicted Tuesday on a counterfeit charge by a federal grand jury in Macon.

Diego Ibarra, 29, was indicted for possession of a counterfeit immigration document, also known as a green card, which is issued by the government to give immigrants an authorized stay in the U.S.

The indictment was presented to the grand jury by Assistant U.S Attorney Michael Morrison.

Diego Ibarra is the brother of Jose Antonio Ibarra, 26, who is in jail in Athens charged with the murder of Augusta University student Laken Riley, while she was jogging at the intramural fields on Feb. 22. She was bludgeoned to death, according to UGA police.

A third brother is also incarcerated in a prison in Lumpkin County. All three brothers entered the U.S. illegally from Venezuela, according to federal authorities.

Diego Ibarra is not linked to the slaying, but he and his brother were both residing in an apartment on South Milledge Avenue at the time of Riley’s death.

If convicted of the federal charge, Ibarra could face a 10-year prison term.
