The New York Times reports “The National Republican Senatorial Committee argued in an amicus brief that the Colorado Supreme Court overstepped in disqualifying former President Donald J. Trump from the primary ballot.” 

In the brief, the NRSC argues, “The right of all citizens to participate in free and fair elections and to vote for the candidate of their choice is the Constitution’s bedrock guarantee of American democracy. The Colorado Supreme Court’s decision barring President Trump from the Republican Party’s primary election ballot breaches that guarantee and, if left standing, threatens to thwart the democratic process and the will of the American people in 2024 and beyond. For that reason, amici support President Trump’s petition for a writ of certiorari and reversal of the Colorado Supreme Court’s unconstitutional decision.” 

Notre Dame Law Professor Derek Muller wrote on X, “This NRSC amicus brief in Trump Colorado ballot case by Noel Francisco & others at Jones Day is a very plausible (perhaps most likely) path forward for the Court to reverse, relying on a U.S. Term Limits-adjacent argument.” 

NRSC Chair Steve Daines has repeatedly attacked the decisions by Colorado and Maine as “illegal” and “election interference.”
