Stockton 7-Eleven clerks in viral beatdown won’t be charged, DA indicates

“The Stockton 7-11 Store Clerks are not & have never been, suspects of the San Joaquin County District Attorney’s Office,” District Attorney Ron Freitas said in a statement. “Any Investigation going forward is to hold accountable the individual who threatened & attempted to rob them.”

      TO THE MAN BEHIND THAT VIDEO FOR WHAT THE BEATING SEEN IN THIS NOW VIRAL VIDEO IS UNDER INVESTIGATION BY THE STOCKTON POLICE DEPARTMENT. THE MORE THAN FIVE MINUTE CLIP SHOWS A MAN EMPTYING SHELVES OF CIGARETS FROM A STOCKTON 7-ELEVEN STORE INTO A TRASH CAN. AND I’M TELLING HIM, NO, NOTHING. WE COULD DO. THERE’S NOTHING YOU COULD DO. IT’S NOTHING. YOU KNOW, WE JUST LET HIM TAKE AND JUST GO AND STORE CLERKS STEPPING IN AS A BYSTANDER RECORDED THE TENSE MOMENTS THAT 7-ELEVEN IS ON SOUTH CENTER STREET IN STOCKTON TRYING TO FILL IT OUT. BECAUSE I SAY MY JOB IS MAKE IT HOME. WE HAVE THESE HERE. IT’S ABOUT A HALF MILE AWAY FROM THE BUSINESS CO-OWNED BY THE MAN WHO TOOK THAT VIDEO WHO WANTED ONLY TO BE IDENTIFIED AS DATA. HOPEFULLY EVERYONE LEARNS IN THIS SITUATION TO WIN A GOOD, BETTER MIND MINDSTATE NEXT TIME. HE SAYS HE WAS JUST STOPPING BY THE 7-ELEVEN FOR RED BULL AND GAS WHEN HE SAW THE MASKED MAN GO BEHIND THE COUNTER. ONCE THE GUY WAS DONE, HE TRIED TO BYPASS THE OTHER EMPLOYEE. THE EMPLOYEE GRABBED THEM AND ANOTHER PLAYER WENT AND GRABBED THE STICK AND THEN FROM THERE, THE FIASCO HAPPENED. SO IT IN THE CLIP, THE MAN IS HIT MORE THAN TWO DOZEN TIMES. THEN I HAVE TO GET REALLY STERN WITH MY WORDS. IT’S ENOUGH. AND THEN SO THEY KIND OF STOPPED AND I KIND OF WAS NARRATING THE SITUATION, LOOK, HE DOESN’T HAVE A GUN. HE’S ALL RIGHT. ARE YOU DONE? ALL RIGHT. NOW IT’S TIME FOR EVERYONE TO GO. HE NEED TO GO AND YOU GUYS NEED TO STOP. STOCKTON POLICE SAID THAT SOMEONE FROM THE BUSINESS EVENTUALLY CALLED POLICE. POLICE SAY A REPORT WAS TAKEN AND THAT THIS IS AN ONGOING INVESTIGATION IS ENOUGH. THAT’S ENOUGH DATA SAYS HE WORRIES THE SITUATION COULD HAVE ESCALATE FURTHER HAD HE NOT BEEN THERE. SAYS THE CITY AND THE PEOPLE IN IT NEED TO STEP UP AND BE BETTER THAN WHAT HE SAW INSIDE. AND WE JUST NEED TO FIGURE OUT TOGETHER AS COMMUNITY AND PEOPLE THAT WE GOT TO LOVE EACH OTHER.       Two Stockton 7-Eleven clerks seen on video attacking a would-be thief shouldn’t expect to be charged in connection with the viral beatdown, the San Joaquin County District Attorney indicated on Tuesday. “The Stockton 7-11 Store Clerks are not & have never been, suspects of the San Joaquin County District Attorney’s Office,” District Attorney Ron Freitas said in a statement. “Any Investigation going forward is to hold accountable the individual who threatened & attempted to rob them.”(Previous coverage in video above: Would be Stockton thief beaten by 7-Eleven clerks, video shows.)Video of the July 29 assault has gained national attention. In the more than five-minute clip, a man can be seen emptying shelves of cigarettes and other products from the store’s shelves before the clerks step in to stop him. The clip shows one of the clerks pinning the man down while another beats the would-be thief with what appears to be a pole.Stockton police said over the weekend they were continuing to investigate what police called a suspected assault and suspected robberies at the 7-Eleven. Police said they believe the same thief was believed to have robbed the store two other times within the same 24-hour period. They said that after their investigation concludes, they would forward the findings to the San Joaquin County district attorney for review.KCRA 3 has reached out to Stockton police about the status of the investigation.

      Video of the July 29 assault has gained national attention. In the more than five-minute clip, a man can be seen emptying shelves of cigarettes and other products from the store’s shelves before the clerks step in to stop him. The clip shows one of the clerks pinning the man down while another beats the would-be thief with what appears to be a pole.
